Terms of Use
These terms govern your use of the electronicrenaissance.ca website (the "Site"), operated by Electronic Renaissance Inc. ("Electronic Renaissance", "we", "us"), a corporation incorporated in Canada. By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
1. The Site is informational
The Site exists to describe our company and its work and to provide support and legal information. Content on the Site is provided for general information only and does not constitute professional advice of any kind — including legal, financial, accounting, or tax advice. You should not rely on the Site as a substitute for advice from a qualified professional.
2. Applications are licensed separately
Applications published by Electronic Renaissance are licensed, not sold, and are governed by their own license terms. Unless a different license is presented to you, applications distributed through the App Store are licensed under Apple's Standard End User License Agreement. Nothing on the Site modifies those license terms, and any descriptions of applications that appear on the Site do not form part of any contract regarding them.
3. Intellectual property
The Site and everything on it — text, design, graphics, logos, and code — are the property of Electronic Renaissance Inc. or its licensors and are protected by Canadian and international copyright and trademark law. You may view and link to the Site freely. You may not reproduce, modify, distribute, or create derivative works from Site content for commercial purposes without our prior written consent. "Electronic Renaissance" and our logos are trademarks of Electronic Renaissance Inc. Apple, iPhone, iPad, and the App Store are trademarks of Apple Inc., registered in the U.S. and other countries; their use on the Site does not imply any affiliation with or endorsement by Apple.
4. Third-party links
The Site may link to third-party websites (for example, Apple's support pages). Those sites are outside our control, and we are not responsible for their content, availability, or privacy practices. A link does not imply endorsement.
5. No warranties
The Site is provided "as is" and "as available", without warranties or conditions of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that its content is accurate, complete, or current.
6. Limitation of liability
To the maximum extent permitted by applicable law, Electronic Renaissance Inc. and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or business opportunity — arising out of or relating to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred Canadian dollars (CAD $100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; where such laws apply to you, some or all of the above exclusions and limitations may not apply, and our liability will be limited to the greatest extent permitted by law. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including under applicable consumer protection legislation.
7. Indemnity
You agree to indemnify and hold harmless Electronic Renaissance Inc. from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site or your violation of these terms.
8. Changes
We may update the Site and these terms at any time. Changes take effect when posted on this page, with the effective date revised above. Your continued use of the Site after changes are posted constitutes acceptance of the revised terms.
9. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that the courts of Ontario have exclusive jurisdiction over any dispute relating to the Site, except where applicable consumer law entitles you to bring proceedings in your own jurisdiction.
